1. Introduction

Please read these Terms and Conditions carefully as they govern your use of, which includes access to, Tramontina UK's services for the purchase of products, including all of our websites and social media platforms that incorporate or link to these Terms and Conditions.

Kindly ensure to include your name, order number, if applicable, and a detailed reason for your email. If we need to contact you, we shall use the same contact details provided by you. Emails and communications are reviewed during our regular business hours Monday through Friday from 9:00am to 5:00pm, excluding holidays. We endeavour to answer all messages within 2 business days.

3. Age And Eligibility Requirements

BY ACCESSING AND USING THE TRAMONTINA UK WEBSITE AND RELATED SOCIAL MEDIA PLATFORMS, YOU AFFIRM THAT YOU ARE 18 YEARS OR OLDER TO ENTER INTO THESE TERMS, OR, IF YOU ARE NOT, THAT YOU ARE 13 YEARS OR OLDER AND HAVE OBTAINED PARENTAL OR GUARDIAN CONSENT TO ENTER INTO THESE TERMS.

Tramontina UK website products are not available for sale to minors. If you are under 18 years old you may not purchase products on our website unless you are supervised by your parents or guardian having responsibility for you.

You represent that any registration and account information that you submit to Tramontina UK is true, accurate, and complete, and you agree to keep it that way at all times.

4. Our Contract With You

When you purchase from us you are agreeing that:

  • We only accept orders when we have checked them.
  • Sometimes we may reject orders.
  • We charge you at the time of purchase.
  • We pass on increases in VAT.
  • We are not responsible for delays outside our control.
  • If you bought online you have a legal right to change your mind within 14 days.
  • You have rights if there is something wrong with your product(s).
  • We can change these terms and conditions.
  • We can suspend supply, and you have rights if we do.
  • We do not compensate you for all losses caused by us or our products/services.
  • We use your personal data as set out in our Privacy Notice. Please consider the link to our Privacy Policy.
  • You have several options for resolving disputes with us.
  • Other important terms and conditions apply to our contract.

We shall charge you at the time of purchase. Thereafter you will receive an email to acknowledge receipt of your order listing a summary of product(s) purchased, the delivery details provided and your payment method. Receipt of this email does not mean that your order has been accepted by us. We will only accept and dispatch orders when we have checked them.

We shall send you a confirmation email advising your order has been dispatched. This will act as acceptance of your order and a contract will be created between you and us.

If we are unable to supply you with a product(s), for example because a product is not in stock or no longer available or due to an error, including a price or description error on our website, we will inform you that your order has been rejected and will not be processed. If you have already paid for the order, we will refund you the full amount no later than 14 days.

5. Our Products

While we take the utmost care to ensure our product descriptions, pictures, information and prices are accurate we do not accept liability for any inaccuracies, errors or omissions. If an error was made, we will make changes as soon as possible. If such change directly affects an order placed, we shall let you know immediately, and the delivery of such product will be possible only if you accept and agree with such change.

If a substantial error is identified after purchase, you will have the option to cancel the order and receive a refund, as expressed in item 11.

5.1 Products May Vary Slightly From Their Pictures

The images of the products on our website are for illustrative purposes only. Products may vary slightly from those images. An accurate product description along with information is available on the product page. We have made every effort to display colours accurately although the functionality and display of your device may not reflect the exact colour of products.

5.2 Stock Availability

Whilst we endeavour to ensure products are always available, there may be times when products will be temporarily out of stock.

5.3 Product Suspension

We can suspend the supply of a product. This may take place to:

  • Deal with technical problems or make minor technical changes;
  • Update the product to reflect changes in relevant laws and regulatory requirements; or
  • Make changes to the product.

5.4 Limitation Of Compensation

Tramontina UK accepts liability for foreseeable losses arising from defects in products or services, as required by applicable consumer protection law. We are not responsible when:

  • Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it.
  • Caused by a delaying event outside our control. As long as we have taken the steps set out in the section we are not responsible for delays outside our control.
  • Avoidable. Something you could have avoided by taking reasonable action, including following our reasonable instructions for use.
  • A business loss. Relates to your use of a product for the purposes of your trade, business, craft or profession.
  • Incorrect use of a product. Each product developed by Tramontina has its own purpose of use. If you use it incorrectly or for others purposes, you shall be exclusively responsible for damages to the products.

6. Pricing

Prices displayed on our website are in British pounds sterling (GBP) and inclusive of UK VAT (sales tax). Pricing excludes delivery costs that will be added to the total amount due. Applicable delivery costs are displayed during the checkout process.

If a price or delivery cost is listed incorrectly we will either contact you and give you the option of reconfirming your order at the correct price. You may accept or cancel the order. We may also reject your order and notify you. This is all at our discretion.

Price changes are subject to change without notice. We may apply special prices.

Tramontina UK operates a standard product pricing policy in the UK and the Channel Islands. This means customers are charged the same prices irrespective of where they live within the region. We believe that price integrity within any currency zone is important. Please note, the Channel Islands is outside the UK VAT charging zone therefore no VAT will be incurred on purchases from the region.

6.1 We Pass On Increases In VAT

If the rate of VAT changes between your order date and the date we supply the product, we adjust the rate of VAT that you pay, unless you have already paid in full before the change in the rate of VAT takes effect.

7. Payment

When purchasing goods online a valid payment method must be used at the time. We accept the following payment types: Visa, MasterCard, Maestro, American Express, Shop Pay, Apple Pay, Google Pay. By submitting an order to us through our site, you are confirming that the payment details provided on your order are valid and correct. All transactions will be in British pounds sterling.

Payments are also accepted through PayPal. Please note if you do not already have an existing PayPal account, you will be required to set up a new account with PayPal directly. Orders placed using PayPal will be charged at the time your order is submitted. If we are unable to fulfil your order for any reason, this charge will be credited back to your PayPal account.

We do not accept cash, cheques, gift cards or vouchers.

8. Your Legal Right To End Our Contract

8.1 Change Your Mind: Right To Reject

You have a right to change your mind and request a refund within 14 days of receipt of your order. If your order consists of multiple goods, the 14-day period begins when you get the last item of the order. This 14-day period is the time you must decide whether to cancel, and then you have a further 14 days to send the goods back to us.

Please refer to our Returns Policy for further information on how to submit your request, Section 11.1.

8.2 Faulty/Damaged Products

If the item you have purchased from us is faulty or damaged you may have a legal right to get the product replaced, have a price reduction, or to get a refund.

Where a damaged or defective item has been delivered to you, please contact us within 48 hours of delivery to organise a return, replacement, or refund.

Please refer to our Returns Policy for further information on how to submit your claim. Section 11.3.

8.3 Other Reasons To End Your Contract

If you decide to end our contract because of something we have done or are going to do prior to delivery, the contract will be terminated immediately, and we will refund you in full for any products which have not been provided.

Some reasons may include:

(a) We have told you about an upcoming change to the product or these terms which you do not agree to.

(b) We have told you about an error in the price or description of the product you have ordered, and you do not wish to proceed.

(c) There is a risk that supply of the products may be significantly delayed for a period of more than 30 days because of events outside our control.

(d) We have suspended supply of the products for technical reasons or notify you we are going to suspend them for technical reasons, in each case for a period of more than 30 days.

9. Cancellation

Cancellations can only occur before dispatch. If your order has been dispatched, we will no longer be able to cancel it although we will make an attempt to contact the courier and stop delivery. However, if the order is delivered, you will have to submit a return request under the section 8.1 Change of mind.

10. Delivery

It is your responsibility to provide us with the correct delivery address and any special instructions where applicable to fulfil your order. This includes the name of the recipient and the full delivery address, including post code, house number and street name.

Please note that we cannot be held liable for any delivery errors that result from missing or incorrect instructions or address details. If you provide an incorrect or undeliverable address, the product may be returned to our facilities and the shipping costs will be deducted from your refund.

We currently only accept orders for delivery to UK addresses, the Channel Islands and the Isle of Man. Please note we cannot deliver to British Forces posted overseas addresses or PO Box addresses.

Estimated delivery will be available on checkout usually within 3 to 5 business days after dispatch. We will send you an email with the carrier’s link so that you can track your order.

Deliveries are only made on business days, Monday to Friday, excluding public holidays. Every effort will be made to meet delivery timescales visible at the time of your checkout. If we experience any significant delays in dispatch or deliveries that may affect your order, we will contact you by email.

Furthermore, external events, such as force majeure, weather conditions, geopolitics and industry strikes, may interfere with carrier services and the delivery date of your purchase.

Oversized items will be flagged on checkout and in your order notification email, both under the section “Shipping Method” which will be “Oversized Shipping Items”. For these items, the carrier may contact you to arrange delivery. Tramontina UK and the delivery company are not responsible for assembling any products.

All deliveries are made to the front door of the provided delivery address.

Please refuse your delivery if there is visible damage to the packaging. Report this to the driver carrying your package and immediately contact our Customer Service team.

11. Return Policy

11.1 Change Of Mind

You have a right to change your mind and request a refund within 14 days of receipt of your order. If your order consists of multiple goods, the 14-day period begins when you get the last item of the order. This 14-day period is the time you must decide whether to cancel, and then you have a further 14 days to send the goods back to us.

If you wish to change your mind on your purchase, please contact us by replying to the order confirmation email or by submitting a contact form. We will send you the instructions to return your order via email.

If you exercise the right to cancel within the statutory 14-day period, the refund will include the standard delivery cost originally paid, in accordance with applicable consumer protection legislation.

Please, be advised that:

  • You must return the product in the same condition it was received, in its original packaging, and both product and packaging must be in perfect condition.
  • Items must be securely packed in a shipping box.
  • The product shall not be used, damaged, or assembled.
  • To qualify for a full refund, you must return the goods in a fully resalable condition.
  • You are responsible for return postage costs. Upon accepting your return request, we will inform you of the postage costs so you can decide whether to proceed with the return.

We understand that you may need to open the packaging and handle the item to assess its nature and characteristics. However, if the item is damaged, excessively handled, or missing components, we reserve the right to make a reasonable deduction from your refund to reflect any diminished value.

Your return will be reimbursed no later than 14 days from the date of receipt of the returned goods.

11.2 General Issues With Our Products

If there is a question, comment or complaint about the product delivered to you, please contact us immediately via Contact Us or by replying to your order confirmation email, explaining the issue you wish to address in detail.

11.3 Faulty/Damaged Products

If the item delivered to you is faulty or damaged, you may have a legal right to receive a replacement or a refund.

Where a damaged or defective item has been delivered to you, please contact us immediately to organise a return, replacement, or refund.

Photos of the product and carton boxes identifying the damage or defect will be required to assess the damage or defect to your product. If you are asked to hold on to the product, please do not dispose of it until we instruct you to do so. Disposing of any damaged/faulty product before we have had the opportunity to inspect it may affect your claim.

An attempt will be made to replace damaged or defective products. However, if this is not possible, we will refund your order.

11.3.1 Exclusions Of Our Responsibility To Replace Defective Product(s)

There are certain circumstances, where at our sole discretion we are not able to accept returns, cancel orders or offer a refund unless the product(s) is faulty, or unless there is any other breach of your statutory rights. These exclusions are as follows:

  • Where you do not have proof of purchase.
  • Improper or incorrect use of the products.
  • Improper maintenance of the products.
  • Due to the natural wear of products.

11.3.2 Exclusions Of Our Responsibility To Replace Damaged Product(s)

Please refuse your delivery if there is visible damage to the shipping package. Report this to the driver carrying your package and immediately contact our Customer Service team. If you accept delivery for a damaged package, we may not be able to refund or replace your order.

A damaged parcel must be reported to the courier at the time of delivery, refused and signed for as damaged. If you accept the delivery and sign for it as “received”, then you are fully liable for the goods.

If damage is discovered after delivery, you must notify Tramontina UK within thirty (30) days to initiate a deduction, replacement of product or refund process.

11.4 Exchanges

We do not accept exchanges. If you wish to change a product you purchased from our shop, you can exercise your right to change your mind within 14 days of receipt of your order. The product must be returned following our return policies. Please refer to topic 11.1 Change of mind.

11.5 Festive Season

For orders placed during the festive season period, between 18 November and 31 December, the return policy is extended to 31 January of the immediately following year. You should inform us of your intention to return the products by 31 January. From the date your return is approved, you will then have a further 14 days to send the goods back to us.

12. Refund Policy

Your refund will be paid using the same means of payment as for the initial transaction and issued when goods are received back and inspected by our team.

Your return will be reimbursed no later than 14 days from the date of receipt of the returned goods.

12.1 Goods Returned Under Change Of Mind

You are only liable for any diminished value of goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

We understand that you may need to open the packaging and handle the item to assess its nature and characteristics. However, if the item is damaged, excessively handled, or missing components, we reserve the right to make a reasonable deduction from your refund to reflect any diminished value.

We also reserve the right to refuse a full refund where the following standards are not met:

  • Goods are unused, disassembled, and undamaged with tags attached in their original packaging.
  • Where you do not have proof of purchase, for example invoice, payment receipt or confirmed order.
  • Where the product(s) are returned without protective packaging.
  • Where the product(s) are not returned in a saleable condition and other conditions above.
  • Returns after the change of mind period, or in disagreement with the applicable returns policy.

12.2 Faulty And Damaged Items

Upon review of your returned damaged or faulty item(s) our Customer Service team will advise you of your refund. The assessment is based on the evidence provided with your claim.

If a manufacturing defect is confirmed and we are unable to replace the item, we will process a refund.

If the damaged item is refused upon delivery and returned to us, and we are unable to replace it, we will process a refund.

13. Other Important Terms Apply To Our Contract

Nobody else has any rights under this contract. This contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

If a court invalidates some of this contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

Even if we delay in enforcing this contract, we can still enforce it later. We may delay in enforcing this contract, but this does not mean that we waive our right to enforce it later.

14. Warranty And Indemnification

14.1 Warranty

Our products come with statutory rights under UK consumer law. If a product is faulty or not as described, you may be entitled to a repair or replacement, or in some cases a refund, in accordance with the Consumer Rights. Additionally, we provide a ninety (90) days commercial warranty for certain product categories. Please refer to individual product descriptions for specific warranty terms. This does not affect your statutory rights. The Warranty covers defects of workmanship and/or materials, when the product is used in normal and domestic conditions. The Warranty does not cover any misuse or normal wear of the products. Some products may have different periods of warranty. For full details of the guarantee period per product range, enter the product page and search for "Product Description” and “Warranty".

Read and apply care and use instructions. To consult the Care & Use of the item, enter the product page and search for "Product Description” thereafter for its “Care & Usage”. You will find specifications and instructions on how to use the product.

The following are excluded from the terms and conditions of the guarantee:

  • Damage caused by normal wear and tear, accident, misuse, abuse or commercial use.
  • Scratches, stains, discolouration, corrosion or damage from overheating, to the interior or exterior of the pan. This also includes the non-stick coating.
  • Consequential damage is expressly excluded from this guarantee.
  • A slight yellowing of the surface can occasionally happen after heating. This is completely harmless and does not affect the performance of the pan and is therefore excluded from the guarantee.

14.2 Indemnification

You agree to indemnify and hold Tramontina UK harmless from and against all damages, losses, and expenses of any kind, including reasonable legal fees and costs, arising out of or related to: (1) your breach of any of these Terms, including any additional Tramontina UK terms and conditions incorporated herein; (2) any content you post or otherwise contribute; and (3) your violation of any law or the rights of a third party.

15.1 Customer Reviews

We would be happy to know your feedback on our products. At the end of the purchase, we may invite you to write a product review and share your experience.

Our goal is to gather opinions of our customers, positive or critical. Do not post any advertising or commercial content, or use our website to perform commercial activity. Do not post offensive or inappropriate content. Tramontina UK is not responsible for user content posted on our website, although we reserve the right to remove inappropriate content at our sole discretion.

Content listed by you is owned by you but when you post a review on our website, you license it to Tramontina UK. By posting a review, you understand that you grant a non-exclusive, perpetual, transferable, sub-licensable, royalty-free, worldwide license to use the contents that you post on our websites, for any purpose, including commercial use, and including the right to create derivative works, translate, reproduce, display, distribute, or modify the contents, and sublicense or assign these rights.

Your review may be visible in other platforms, such as search engines and social media. Your review will be visible until removed.

If you want to remove your content after publication, you may contact Tramontina UK by emailing help.tuk@tramontina.com. You understand that the removed content may persist on our systems or other platforms to the extent your content has been publicly posted and may be accessed by or shared with other users or third parties who have not deleted them. 16. Promotions And Prize Awards

Any contests, sweepstakes, or other promotional activities made available through our Social Media or Third-Party Websites may be governed by rules that are separate from these Terms & Conditions. If you choose to participate in any Promotions, you should review the applicable rules as well as the Terms & Conditions provided by the Online Sales Platform.

17. We Can Change Services And These Terms

We reserve the right to amend these terms and conditions from time to time. Any revisions will be posted on our website. We encourage you to review these terms and conditions regularly for any changes. Your continued use of this website will be subject to the terms and conditions in effect at the time of use.

18. Changes We Can Always Make

We can always change a service:

  • To reflect changes in relevant laws and regulatory requirements; and
  • To make minor technical adjustments and improvements, for example to address a security threat.
